Specific Terms & Conditions

1. Parties

1.1. The Black Friday Offer is provided by Baitwater Marketing Management LLC, operating under the brand name Mindpillar ("Baitwater", "Mindpillar", "we", "us", "our").
1.2. All contractual obligations, rights, and liabilities under these Terms rest with Baitwater Marketing Management LLC.
1.3. "You" or "Customer" refers to the individual purchasing access to the course under this Black Friday Offer. .

2. The Black Friday Offer

2.1. The Black Friday Offer applies only to the online course currently titled "Path to Trading Consistency" (the "Course").
2.2. Under this promotion, eligible customers receive:

• Immediate access to all currently available modules (final 2 modules will be added by mid-January 2025 at no additional cost)
• Lifetime access to the Course content (for as long as Baitwater continues to host the Course)
• Access to any standard community features described on the sales page at the time of purchase

2.3. The Black Friday price is USD 1,050 per customer, inclusive of any normally applicable Baitwater course access fees but exclusive of any bank fees, currency conversion costs, or taxes/charges imposed by your payment provider.

3. Course Content & Delivery Timeline

3.1. Upon successful payment, you will receive immediate access to all currently available course modules.
3.2. The following will be delivered by mid-January 2025:

• The final 2 course modules
• All supplementary course attachments, workbooks, templates, and downloadable documents
• Further platform stability improvements and bug fixes

3.3. If there is any delay in delivery beyond mid-January 2025, Baitwater will notify all enrolled students and extend refund rights by 30 days past the actual delivery of all materials.
3.4. Baitwater commits to communicate updates about module releases and platform improvements via email to all enrolled students throughout the presale period.

4. Promotion Period

4.1. The Black Friday Offer is valid only between:

• Start: 26 November 2025, 00:00 CET
• End: 3 December 2025, 20:00 CET

4.2. Baitwater may close the Offer earlier if the seat cap described in Section 5 is reached.
4.3. After the Promotion Period ends, Baitwater is under no obligation to honor the Black Friday price for any new purchases.

5. Seat Limitation (First 25 Customers)

5.1. The Black Friday Offer is strictly limited to the first 25 (twenty-five) eligible customers who successfully complete payment at the Black Friday price.
5.2. A "successful" purchase is defined as:

• Full payment of USD 1,050 received and
• Payment authorized/settled by Baitwater's payment processor.

5.3. Once 25 successful purchases have been completed:

• The Black Friday Offer will be closed to further enrollments; and/or
• The price may be increased or the offer removed from the website.

5.4. Baitwater will make reasonable efforts to ensure the website and any visible counters reflect remaining seats accurately, but technical delays or discrepancies do not create any right to purchase at the promotional price once the 25-customer cap has been reached.

6. Launch Price & Future Pricing

6.1. The intended official launch price of the Course is USD 3,497, to be charged for new customers from the formal launch date planned for mid-January 2025 (the "Launch Price") which will be communicated within official channels once set (please note that month may change).
6.2. The Black Friday price of USD 1,050 is a pre‑launch promotional price offered only during the Promotion Period and only to the first 25 customers.
6.3. Baitwater reserves the right, in its sole discretion, to:

• Adjust the Launch Price (upwards or downwards)
• Introduce additional pricing tiers or promotions in the future
• Change or discontinue elements of the offer for new customers

Such changes do not affect the validity of purchases already made under the Black Friday Offer.

7. Access to the Course

7.1. Upon successful payment, you will receive access credentials or enrollment confirmation using the email address or account details you provided at checkout.
7.2. Course access is delivered digitally via Baitwater's chosen learning platform. No physical products are included.
7.3. "Lifetime access" means:

• Access for as long as Baitwater continues to host and commercially offer the Course
• Subject to normal technical maintenance, platform changes, and reasonable business decisions (e.g., migrations, consolidations, or discontinuation with reasonable notice).

7.4. You are responsible for maintaining secure access to your login credentials and for having adequate internet connectivity and compatible devices to access the Course.

8. Presale Limitations & Known Issues

8.1. You acknowledge and agree that:

• Not all course modules and supplementary documents are available immediately
• The final 2 modules are in development and will be released by mid-January 2025
• The course platform may have technical issues during the presale period, which are actively being resolved
• Some course features may not function as intended until all modules and bug fixes are released

8.2. By enrolling in the Black Friday presale offer, you accept these limitations as part of the promotional discount.
8.3. If presale limitations are unacceptable to you, refunds are available within 14 days of purchase subject to the access conditions outlined in Section 9.

9. Refund Policy

9.1. All Purchases Are NON-REFUNDABLE
All purchases of the Black Friday Pre-Launch Offer are non-refundable and final, except as required by mandatory consumer protection laws in your jurisdiction.
9.2. Mandatory Law Override
Nothing in this refund policy limits any rights you may have under mandatory consumer protection laws in your country that cannot be waived by contract. If your country's laws grant you statutory refund or withdrawal rights, those rights apply regardless of this non-refund policy.
9.3. Exception – Delivery Failure
If Baitwater fails to deliver all remaining modules and supplementary documents by 31 January 2025, all enrolled students may request a FULL REFUND at any time.
9.4. Fraud or Unauthorized Transaction
If you believe there has been fraud or an unauthorized transaction, you must contact your bank/payment provider and also notify Baitwater Marketing Management LLC (operating as Mindpillar) promptly at support@mindpillar.com.
9.5. Refund Processing:

• Approved refunds will be processed within 7 business days to your original payment method
• If a technical error results in duplicate charges, Baitwater will refund any duplicate payment
• Chargebacks filed with payment processors will be contested

9.6 Fraud Prevention
Baitwater reserves the right to deny refunds if:

• Content access data shows abuse or manipulation
• Multiple accounts from same customer accessing course
• Refund requested with intent to re-purchase at a later date

9.7 All Other Purchases:
All other purchases under the Black Friday Offer follow Baitwater's standard refund policy as outlined in the general Terms of Use.
9.8. Fraud or Unauthorized Transaction:
If you believe there has been fraud or an unauthorized transaction, you must contact your bank/payment provider and also notify Baitwater Marketing Management LLC (operating as Mindpillar) promptly at support@mindpillar.com.

10. Educational‑Only Nature & No Advice

10.1. The Course and all related materials are provided for educational purposes only.
10.2. Nothing in the Course, on the website, in any communication from Baitwater (operating as Mindpillar), or in any associated groups or calls should be interpreted as:

• Financial advice
• Investment advice
• Trading recommendations
• Legal, tax, or accounting advice

10.3. You acknowledge that:

• All examples, strategies, and techniques are illustrative
• You are solely responsible for any trading or investment decisions you make
• You will consult qualified, independent financial or legal professionals before making investment or trading decisions.

11. Trading & Risk Disclosure

11.1. Trading in financial instruments (including but not limited to cryptocurrencies, stocks, forex, derivatives, and CFDs) involves substantial risk of loss and is not suitable for all individuals.
11.2. You may lose some or all of the capital you risk. You should only trade with money you can afford to lose entirely.
11.3. Past performance, historical data, backtests, or any example of returns are not indicative of future results.
11.4. Baitwater makes no guarantees regarding:

• Profitability
• Specific returns
• Improvement in win rate
• Reduction of "bad trades"
• Any specific trading outcome

11.5. Any testimonials, case studies, or results shown:

• Profitability
• Represent individual experiences only
• Are not typical or guaranteed
• Do not create any expectation of similar outcomes for you

11.6. Most traders lose money. Results vary significantly by individual based on market conditions, discipline, experience, and numerous factors beyond anyone's control.

12. Age & Eligibility

12.1. To purchase under the Black Friday Offer, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts in your jurisdiction

12.2. By purchasing, you represent and warrant that you meet these requirements.

13. Use of Content & Intellectual Property

13.1. All Course content, including videos, text, graphics, tools, and downloads, is owned or licensed by Baitwater Marketing Management LLC (operating as Mindpillar) and protected by intellectual property laws.
13.2. Your Black Friday purchase grants you a personal, non‑transferable, non‑exclusive license to access and use the Course for your own education.
13.3. You may not:

• Share, resell, redistribute, or publicly display Course content
• Provide your login details to third parties
• Record, copy, or upload content to other platforms
• Create derivative works for commercial purposes without express written permission

13.4. Violation of these terms may result in suspension or termination of access without refund and may expose you to legal action.

14. Early Access, Beta, and Prior Tiers

14.1. Prior to the Black Friday Offer, Baitwater ran a limited early access program at a different price for a small number of community members in exchange for feedback and testimonials.
14.2. That early access program is closed and no longer available. It does not create any obligation for Baitwater to offer the same pricing or conditions to new customers.
14.3. Pricing offered to any previous tiers or beta participants has no bearing on the Black Friday price or any future pricing.

15. Inner Circle Mentorship (If Displayed on Same Page)

15.1. If the "Inner Circle Mentorship" offer is displayed on the same page, it is a separate, optional high‑ticket program with its own specific terms.
15.2. Purchasing the Course under the Black Friday Offer:

• Does not enroll you into the Inner Circle Mentorship
• Does not entitle you to Inner Circle bonuses, coaching, or trade reviews

15.3. Inner Circle Mentorship is also educational only, carries substantial risk of loss, and does not guarantee results.

16. Compliance & Jurisdiction

16.1. Baitwater Marketing Management LLC (operating as Mindpillar) aims to comply with applicable consumer protection and advertising laws, including but not limited to:

• EU Regulations: Including MiCA (Markets in Crypto‑Assets Regulation) where educational crypto‑related content is concerned, UCPD (Unfair Commercial Practices Directive), and general consumer protection laws
• US: Federal Trade Commission (FTC) rules on advertising, endorsements, and unsubstantiated claims
• Canada: Competition Act and Canadian Securities Administrators guidance for educational programs
• Belarus: Applicable Belarusian consumer protection laws

16.2. Nothing in these Terms limits any rights you may have under mandatory consumer protection laws in your country that cannot be waived by contract.
16.3. Subject to such mandatory laws, any disputes relating to the Black Friday Offer will be governed by the governing law and jurisdiction specified in Baitwater's general Terms of Use.

17. Changes & Interpretation

17.1. Baitwater may update these Black Friday Terms to correct errors, clarify language, or reflect minor changes to the Offer, provided such changes do not materially disadvantage customers who have already purchased.
17.2. The version of these Terms in force at the time of your purchase will apply to your transaction.
17.3. Headings are for convenience only and do not affect interpretation.

18. No Liability

18.1. Baitwater Marketing Management LLC and its officers, directors, employees, and agents disclaim all liability for:

• Any losses, damages, or adverse outcomes resulting from use of the Course educational content
• Past performance does not guarantee future resultsAny trading strategies or techniques discussed
• Any platform services or materials provided
• Any use or reliance upon information in the Course

18.2. In no event shall Baitwater be liable for:

• Lost profits
• Indirect, incidental, special, or consequential damages
• Any trading losses or financial harm

even if advised of the possibility of such damages.

19. Third‑Party Services & Data Providers

19.1. The Course may reference or use third‑party services, including but not limited to TradingView®. These services operate independently and are not affiliated with or endorsed by Baitwater Marketing Management LLC.
19.2. Baitwater is not responsible for third‑party service availability, accuracy, or any errors or omissions in data provided by third parties.

20. Performance Statistics & Dewald's Track Record

20.1. Dewald (or associated individuals) is a founding member of the Bitcoinsensus Legends Trading team.
20.2. Any statistics, performance metrics, or results mentioned may represent:

• Sole individual performance
• Team performance
• Historical backtests or simulation results

20.3. Past performance does not guarantee future results. Please verify all performance claims carefully before enrolling.
20.4. Any mention of results, profits, or performance improvement is for educational illustration only and does not constitute a promise or guarantee of similar results for you.

21. Platform Disclaimers

21.1. This website and Mindpillar are not affiliated with, endorsed by, or part of:

• Facebook, Inc. or Meta Platforms, Inc.
• Google LLC or Alphabet Inc.
• Any other social media or technology platform

21.2. Any branded logos or references are used for informational purposes only.

22. Acceptance & Binding Agreement

22.1 By clicking either "Start The Course” or “Join Inner Circle”or otherwise proceeding with the purchase at the Black Friday price USD 1,050, you confirm that:

• You have read and understood these Black Friday Terms & Conditions
• You have read and understood Baitwater's general Terms of Use and Privacy Policy
• You understand the educational‑only nature of the Course
• You understand that not all course content is available immediately and final modules/attachments will be delivered by mid-January 2025
• You accept the refund conditions outlined in Section 9, including the 25% content access threshold
• You acknowledge the substantial risks involved in trading
• You are at least 18 years old and legally capable of entering into this agreement
• You are not a resident of any jurisdiction where this offer is prohibited by law

24. Entire Agreement

These Black Friday Terms & Conditions, together with Baitwater's general Website Terms of Use and Privacy Policy, constitute the entire agreement between you and Baitwater regarding the Black Friday Offer and supersede all prior or contemporaneous communications, representations, or agreements.
